Bid On The Go is currently in BETA and is provided on an "AS-IS" and "AS-AVAILABLE" basis. Features may change, have bugs, or be discontinued without notice. By using this service, you acknowledge and accept these limitations.

1. Acceptance of Terms

By accessing or using Bid On The Go ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Bid On The Go ("we," "us," or "our").

Bid On The Go is a software tool designed to assist construction contractors, tradespeople, and similar professionals in generating estimates, bids, and related documentation. The Service analyzes project information you provide and generates suggested pricing, material lists, and project scope documentation.

3. Estimate Accuracy Disclaimer - IMPORTANT

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

  • All estimates, prices, material lists, labor calculations, project timelines, and other outputs generated by the Service are approximate and MAY CONTAIN ERRORS, INACCURACIES, OR OMISSIONS.
  • Automated estimates may not account for all site-specific factors, local pricing variations, or unique project requirements. The Service may generate prices, quantities, or specifications that are significantly incorrect.
  • YOU, AS THE CONTRACTOR OR USER, ARE SOLELY AND ENTIRELY RESPONSIBLE for reviewing, verifying, and validating ALL information generated by the Service before using it in any bid, estimate, contract, or communication with clients.
  • The Service is a tool to assist your work, NOT A SUBSTITUTE for professional judgment, industry expertise, local pricing knowledge, or on-site assessment.
  • WE ARE NOT LIABLE for any lost profits, lost business opportunities, under-bidding, over-bidding, project losses, contract disputes, or any other damages arising from reliance on generated estimates without proper verification.

4. User Responsibilities

As a user of the Service, you agree to:

  • Verify all generated prices against current local material and labor costs
  • Review all material lists for accuracy and completeness
  • Conduct proper site assessments before finalizing any estimate
  • Ensure all generated content complies with local building codes and regulations
  • Maintain appropriate professional licenses and insurance for your trade
  • Use the Service only for lawful business purposes
  • Keep your account credentials secure and confidential

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES.
  • OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

6. Intellectual Property

You retain ownership of all content you input into the Service. You grant us a limited license to process your content solely for the purpose of providing the Service. We retain ownership of the Service, including all software, algorithms, and user interface elements.

7. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time by contacting us at support@bidonthego.com.

8. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service or by email. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
